Using Images, Reusing Images and Model Releases
All people depicted in jimbatty.com images are real and engaged in real activities. Very few pictures are model released.
Editorial pictures are those that inform, educate, even entertain. Generally, pictures for editorial use do not require model releases even those which show identifiable people.
Exceptions to the above include editorial usage of people pictures which involve sensitive issues such as AIDS/HIV, drug abuse, child abuse, or mental handicap. In these types of scenarios, a model release would be required. Further, sensitive use of pictures requires that any attribution of strong moral or political viewpoints to people depicted in editorial pictures for example regarding abortion where such viewpoints are not obvious, demands a model release.
Commercial/corporate pictures sell, promote or recommend products or services. All pictures involving identifiable people for commercial use do require model releases.
But, if a person is not identifiable for example, because their face is obscured, they appear in silhouette, are viewed from behind, or are depicted as a blurred figure a release is generally not required. The jimbatty.com collections contain a number of 'people in blurred motion' images for this purpose as well as aesthetic reasons.
Note that using any image of a person even a model released one in an overly negative or defamatory way may violate a model's rights.
It is your responsibility, as the publisher of the images, to ensure that all images are used appropriately. Failure to do so could leave you open to legal action and the confiscation of published materials.
